The petitioner seeks bail in connection with Shahpur P.S. Case No. 204 of 2018 registered for offences punishable under sections 25(1-b) a/ 26/ 35 of the Arms Act. As per FIR, the police party on secret information reached at the place of occurrence and found that several persons assembled to commit crime and after some chase they apprehended the petitioner and recovered 36 live cartridges on search.
It has been submitted that the petitioner has been falsely implicated in the present case. He has clean antecedent and is in custody since 06.07.2018.
Patna High Court Cr.Misc. No.55853 of 2018 (2) dt.28-09-2018 2/2 Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur in connection with Shahpur P.S. Case No. 204 of 2018, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
