JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-08-2016 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with Industrial Area P.S. Case No. 46 of 2016, registered under Sections 366, 363/34 of the Indian Penal Code. The accusation is of kidnapping of minor daughter of the informant for the purpose of performing marriage. Learned counsel for the petitioner submits that statement under Section 164 Cr.P.C. of the victim was recorded in which she stated about performing the marriage with this petitioner on 28.04.2016 according to her sweet will. The Magistrate, who recorded the statement under Section 164 Cr.P.C. assessed the age of the victim as 18 years and in Medical
