1. The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Vinod Kumar For the Opposite Party/s : Smt. Rita Verma ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-09-2018 Heard the parties.

This application has been filed for modification of order dated 13.06.2018 passed in Cr.Misc. No.30412 of 2018 whereby the petitioner was directed to be released on bail in the event of his arrest or surrender before the learned court below within six weeks from that day but inadvertently in the cause title in the address of the petitioner name of the police station Shahjahanpur has wrongly been typed in place of police station -Fatuha, as detailed in the F.I.R. due to which the petitioner could not surrender. Learned counsel for the petitioner prays for making necessary correction in the address of the petitioner in the cause title accordingly.

From perusal of the F.I.R. it appears that in the address

Patna High Court Cr.Misc. No.55213 of 2018 (2) dt.05-09-2018 2/2 of the petitioner name of the police station is Fatuha but in the title cause title name of the police station has been mentioned as Shahjehanpur.

Under the above circumstance, let the name of the police station of the petitioner be read as 'Fatuha' in place of 'Shahjehanpur'. Accordingly, order dated 13.06.2018 passed in Cr.Misc. No.30412 of 2018 is modified to the extent stated above, and consequently, period of surrender of the petitioner is extended by further four weeks.

This modification application is disposed of to the extent stated above.
