Mr. Smt. Renuka Ratnakar ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-09-2018 Heard the learned counsel for the petitioner and the State.

The petitioner seeks bail in connection with Biharsharif Mahila P.S. Case No. 127 of 2017 dated 01.07.2017 instituted for the offences under Sections 354(B) and 504 of the Indian Penal Code and Sections 4 and 8 of the Protection of Children from Sexual Offences Act, 2012.

The victim has alleged that while she had come out of her house for attending to the call of nature, the petitioner caught her from behind and made attempts to disrobe her. The victim could manage to extricate herself by biting the petitioner. It has further been alleged that the informant threatened her that in case she reported the matter to anybody else, she would again be teased.

Patna High Court Cr.Misc. No.54487 of 2018(2) dt.04-09-2018 2/2 Learned counsel for the petitioner has submitted that the date of the occurrence has not been provided in the FIR. The allegations, on face of it, appear to be vague for not providing as to when was the victim subjected to such behaviour of the petitioner. There is a prior land dispute.

The petitioner does not have any criminal antecedent and he is in custody since 11.06.2018. Regard being had to the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Nalanda at Biharsharif in connection with Mahila P.S. Case No. 127 of 2017.
