====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 395 and 397 of the Indian Penal Code. It is alleged by the informant that some unknown persons committed dacoity in his house and on protest made by his son (Bimal Kumar) accused persons opened fire upon him and he sustained injury.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.07.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the FIR. He has not been put on T.I. parade. Except for the confessional statement of co-accused, there is no substantive
Patna High Court Cr.Misc. No.35038 of 2016 (3) dt.19-10-2016 2/2 evidence to suggest the implication of the petitioner in the present case. Recovered article has not been put on T.I. parade to ascertain whether same was looted article or not.
On behalf of the State, it has been submitted that the petitioner is not named in the FIR.
Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Samastipur in connection with Samastipur Mufasil P.S.Case No. 213 of 2015.
