Petitioner is accused in connection with Lakhisarai (Kabaiya) P.S. Case No. 332 of 2018 registered under Sections 302, 120(B), 34 of the Indian Penal Code and Section 25(1-b)a and 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the co-accused having more or less similar allegation has already been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 80515 of 2019, which is evident from Annexure-4, and the case of this petitioner stands of similar footing. The petitioner is rotting in judicial custody since 18.01.2019.
