The instance application for regular bail has been filed by the petitioner in connection with Jakinagar P.S. Case No. 71 of 2018 instituted for the offence u/s 8/20(B) of the N.D.P.S. Act.

As per FIR, prosecution case relates to recovery of 130 kg contraband Ganja from a vehicle bearing Reg. No. TR02D-0365 and the petitioner is alleged to have arrested on spot.

Earlier the application for regular bail of the petitioner was rejected by order dated 24.7.2019 passed in Cr. Misc. No. 37241 of 2019.

In pursuance to the direction of this Court, a report

Patna High Court CR. MISC. No.18885 of 2023(3) dt.18-07-2023 2/2 with regard to the present stage of trial has been received by which it appears that the trial is likely to be concluded within a period of two months.

As the trial is likely to be concluded in near future, at present this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected. However, learned trial court is directed to conclude the trial within stipulated period of time ( i.e. two months) as the petitioner is languishing in judicial custody since 16.5.2018.
