Petitioner seeks bail in a case registered under sections 394, 412 of the Indian Penal Code and sections 25 (I-b) a, 26 of the Arms Act.
Taking into consideration that petitioner was caught along with co- accused just after the alleged occurrence and firearms were recovered from the conscious possession of the petitioner whereas looted money is said to have been recovered from possession of other accused, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Birpur (Bhim Nagar O.P) P.S. Case no. 33/2016 pending in the court of the Chief Judicial Magistrate, Supaul stands rejected.
