JUSTICE SUDHIR SINGH ORAL ORDER 21-09-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Section 302/34 of the Indian Penal Code.
It is alleged by the informant that this petitioner along with other accused persons surrounded the husband of the informant and started abusing and assaulting him. The petitioner and other co-accused caught hold husband of the informant. Coaccused Sushil Kumar assaulted the husband of the informant with Chhura in his stomach and thereafter he succumbed to his injury.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.03.2016. Charge sheet has been submitted in the present case. The petitioner has got no criminal
Patna High Court Cr.Misc. No.32680 of 2016 (3) dt.21-09-2016 2/2 antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is said to have caught hold of the deceased. The main allegation of assault is alleged against co-accusedd Sushil Kumar. No injury has been attributed against the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Kanhauli P.S.Case No. 25 of 2015.
