JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2020 The petitioner, who is a person of clean antecedents and is in custody since 19.02.2020, seeks bail in connection with Case No. C-7-33/2014 dated 05.05.2014 instituted for the offence under Section 47(a) of the Bihar Excise Act, 1915.

It appears that 80 litres of liquor has been recovered from the house of the petitioner on a secret information provided to the police. The petitioner claims that the house from where recovery has been made does not belong exclusively to him.

The petitioner has wrongly been made accused

Patna High Court CR. MISC. No.16597 of 2020(2) dt.13-05-2020 2/2 in this case even though he is a person of clean antecedents and has no connection with the said recovery.

Considering the nature of accusation and period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II, Banka in connection with Case No. C7-33/2014.
