JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Kalyanpur P.S. Case No. 78 of 2018 registered for the offences punishable under Sections 306/34 of the Indian Penal Code. Petitioner happens to be husband of the deceased and admittedly, the marriage of petitioner was solemnized with the deceased in the year 2006 and the deceased gave birth to a child out of the above stated wedlock. However, the relation of petitioner became strained with his wife and the deceased filed criminal case against the petitioner six months prior to institution of the present case. It is also an admitted case of the informant that deceased committed suicide at her natal home. Although

No.57156 of 2018 (2) dt.20-09-2018 2/2 informant claims that deceased having got information regarding second marriage of the petitioner, committed suicide but considering the aforesaid facts and circumstances as well as submissions of the parties particularly, keeping in mind that much prior to institution of the present case the petitioner had filed a suit for restitution of conjugal right and deceased committed suicide at her natal place, let petitioner in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur in Kalyanpur P.S. Case No. 78 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
