2. The petitioner seeks bail in connection with Nawanagar P.S. Case No. 177 of 2023 registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The petitioner is the assailant of the deceased who is none other but his own sister.

4. Learned counsel for the petitioner has tried to make out some story which is unbelievable. The petitioner is in custody since 01.03.2024.

5. Learned counsel for the State and learned counsel for the informant have vehemently opposed the prayer for bail.

6. Considering the fact that the petitioner is the assailant of the deceased, I am not inclined to grant bail to the petitioner.

7. Accordingly, the application stands dismissed.

8. Since, in the trial, no witness has appeared as contended by the petitioner, the Superintendent of Police, Buxar is directed to ensure the appearance of the witnesses in the trial.

9. Learned counsel for the informant undertakes to produce the witnesses on the date fixed and submits that he will not delay the trial.

10. If the trial is delayed by the prosecution, this Court will consider the bail application of the petitioner. (Sandeep Kumar, J) P. Kumar U T
