JUSTICE SANJAY PRIYA ORAL ORDER 03-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Matihani P.S. Case No. 78 of 2013 instituted for the offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that in the written report there is specific allegation of causing firearm injury to the son of informant against Md. Fekna and Md. Imtiyaz. There is general and omnibus allegation against the petitioner that after sustaining gun shot injury by the son of the informant, this petitioner also fired and told that son of the informant has died. Petitioner is in custody since 11.06.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

Patna High Court Cr.Misc. No.53971 of 2018 (2) dt.03-10-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Matihani P.S. Case No. 78 of 2013, subject to the condition that both the bailors will be the close relatives of the petitioner.
