The petitioner is apprehending arrest in a case registered for the offences punishable under section 376 of the Indian Penal Code and section 4 of The Protection of Children from Sexual Offences Act.

The accusation against the petitioner is that he ravished the informant.

It is submitted by the learned counsel for the petitioner that as per medical opinion no sign of rape was found and the informant has retracted from the initial version and has filed a petition to that effect before the learned court below as contained in Annexure 2.

Patna High Court Cr.Misc. No.35057 of 2015 (2) dt.19-08-2015 2/2 The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Mahila P.S. Case No. 22 of 2014 pending in the court of learned ACJM, Samastipur. This application is disposed of with the aforesaid observation/direction.
