The petitioner is languishing in custody since 27.02.2019 in a case registered for the offences punishable under Sections 147, 149, 341, 342, 323, 325,504, 506, 307 and 379 of the Indian Penal Code.
The prosecution case got initiated on the Fardbeyan of Sarvendra Kumar, recorded by A.S.I. Anjani Kumar, Islampur Police Station on 08.09.2018 at 9.30 P.M., to the effect that on the same day at 6.30 P.M., the informant was returning to his home, but on the way, all the FIR named accused persons, including the petitioner along with 5-7 unknown variously armed surrounded him and started assaulting. It is alleged that the accused persons kept the

It is submitted by learned counsel for the petitioner that the accusation is omnibus and general against several persons and the injuries have been found simple in nature. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent. Learned APP for the State submits that the petitioner is named in the FIR and he participated in the incident of assault.
Considering the accusation being omnibus and general coupled with statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-III, Hilsa(Nalanda) in connection with Islampur P.S. Case No 308 of 2018.
