JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 120(B) & other minor sections of the Indian Penal Code and 27 of the Arms Act.

Petitioner is named in the first informant report but the informant claims only to this extent that having heard the sound of firing, when he went in search of the deceased, he saw the petitioner and other FIR named accused, running having rifles in their hands.

Submission on behalf of petitioners is that none has seen actual killing of the deceased and having similar allegation, co-accused Ravindra Yadav and others have already been granted

Patna High Court Cr.Misc. No.35395 of 2016 (5) dt.04-10-2016 2/2 privilege of bail by different benches of this court No doubt, petitioner carries criminal antecedent of some cases but considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Barh P.S.
