The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 323, 307, 353, 504/34 of the Indian Penal Code.

As per allegation in the FIR, petitioner along with other co-accused person have created hindrance to the police personnel while police are bringing them to produce before the Court below. The petitioner in connivance with the co-accused Sanjeet Ram @ Khokha Baba, catch hold the neck of the informant and started to press.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in the present case due

Patna High Court CR. MISC. No.23003 of 2023(3) dt.02-08-2023 2/2 to personal grudge of the informant. General and omnibus allegations have been levelled against the petitioner. Injury received by the injured is simple in nature. The petitioner is languishing in judicial custody since 23.07.2019. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Katihar Sahayak P.S. Case No. 468 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Additional Sessions Judge-II, Katihar.
