The instant application has been filed for modification of order dated 27.2.2020 passed in Cr. Misc. no.61323 of 2019 whereby while granting bail to the petitioner in connection with Trial no.1034 of 2019, arising out of Complaint Case no.345 of 2019, the petitioner was directed to surrender in the learned court below within six weeks.

It is submitted by learned counsel for the petitioner that the petitioner could not surrender for reasons beyond his control as also the situation arising out of Covid-19 pandemic. Further, in compliance of the direction of this Court, cost of

Patna High Court CR. MISC. No.26048 of 2021(3) dt.06-10-2021 2/2 Rs.5,000/ has been deposited in the Patna High Court Legal Services Committee.

Having heard learned counsel for the parties, the instant modification application is allowed and the order dated 27.2.2020 passed in Cr. Misc. no.61323 of 2019 is modified to the extent that the period granted to the petitioner to surrender in the learned trial court is extended for a further period of six weeks from today. Remaining part of the order dated 27.2.2020 shall remain unchanged.

The application stands allowed.
