JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 20.11.2017 passed in Cr.Misc.No. 55873 of 2017 and allegation against the petitioner is that he assaulted the informant, causing injuries to him and there is also allegation of demand of extortion and petitioner is accused in 14 other cases also.

Submission of learned counsel for the petitioner is that he is in custody for more than one year and no offence is made out under Section 307 IPC against him.

Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail and submitted that in this case charge has been framed and trial is going on. Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.55672 of 2018 (2) dt.19-09-2018 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.

However, learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if trial is not concluded within the said period, petitioner shall be released on bail by the trial court to its own satisfaction. With the above observation, this application is disposed of.
