JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 304B and 201/34 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons have disappeared and killed daughter of the informant due to non-fulfilment of demand of dowry. It has been submitted on behalf of the petitioner that he is in custody since 17.4.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner has falsely been implicated in the present case.
A number of witnesses in the case diary have stated that there was love affair of the deceased and she used to talk with a boy. On earlier occasion also she had fled away with the boy. After investigation police has submitted Chargesheet under Sections 364 and 498-A of the Indian Penal Code and Sections 3 / 4 of the Dowry Prohibition Act.
On behalf of the State, it is submitted that petitioner is named in the F.I.R. and is husband of the deceased.

No.33328 of 2016 (3) dt.22-09-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-5, Motihari , in connection with Pakaridayal P.S. Case no. 47 of 2014.
