The petitioner in the present case is seeking regular bail in connection with Bhorey P. S. Case No. 76 of 2014 registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code.

Learned counsel for the petitioner submits that the informant in the present case has alleged that this petitioner has taken a sum of Rs. 90,000/- in the name of sending him foreign country. The petitioner has also allegedly received Rs. 15,000/- in the name of medical expenses and even the Passport of the informant has not been returned by the petitioner.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated because this petitioner happens to be related with the brother of one Barishter Singh with whom the

Patna High Court Cr.Misc. No.51905 of 2018(2) dt.20-09-2018 2/2 informant has enmity. Learned counsel submits that for the present the petitioner would be ready to deposit Rs. 50,000/- with the court below subject to the result of the case.

Learned APP is present and has opposed the prayer of bail.

Considering the facts and circumstances of the case wherein the allegation against the petitioner is that he had assured the informant to arrange for him Visa for the foreign country and in the name of that Rs. 90,000/- has been taken from the informant and Rs. 15,000/- was spent in the name of medical expenses, let the petitioner Rampravesh Singh @ Ramprawesh Singh be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate XII, Gopalganj in connection with Bhorey P. S. Case No. 76 of 2014, with condition that the petitioner shall deposit a sum of Rs. 25,000/- with the court below which will be paid to the informant subject to the result of the case at the time of filing of the bail bonds and rest Rs. 25,000/- shall be paid within a month after his release this is further subject to the condition laid down under Section 437 (3) Cr.P.C.
