Petitioner seeks bail in a case registered under section 302 and other minor sections of the Indian Penal Code and 27 of the Arms Act.

Petitioner is said to have caught hand of the deceased at the time of alleged occurrence and according to the prosecution case itself, it was co- accused Rahul Yadav who shot fire on the deceased. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the fact that the petitioner does not have any criminal antecedent and is languishing in jail custody since 15.3.2016, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Buxar (T) P.S. Case no. 74/2016.
