JUSTICE ARUN KUMAR ORAL ORDER 09-02-2018 Heard the learned counsel for the petitioner and the learned counsel appearing for the State.

This is a petition for grant of regular bail for offences under Sections 365, 366A, 376 and 323 of the Indian Penal Code. Allegation, in brief, is that the prosecutrix was deceitfully kidnapped by the petitioner and raped several times. Submissions of the learned counsel for the petitioner is that the said kidnapping is alleged to be on 02.07.2016 but no information was given by any family members. Later on complaint was filed by the prosecutrix on 11.08.2016, both are covillagers and she had eloped with the petitioner, who is a railway employee and the girl is major, 20 years of age. The complainant and the prosecutrix were talking for a month with each other during the said period.

Having considering the facts and circumstances,

Patna High Court Cr.Misc. No.837 of 2018 (3) dt.09-02-2018 2/2 aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Kako P.S. Case No. 148 of 2016 to the satisfaction of the Chief Judicial Magistrate, Jehanabad.
