Petitioner prays for bail in connection with Maheshkhunt P.S.Case No. 50 of 2018 registered for the offence punishable under Section 379 of the Indian Penal Code.

Allegation as per FIR is of theft of Bolero vehicle and petitioner is not named in the FIR.

Submission of learned counsel for the petitioner is that in the confessional statement of co-accused the name of petitioner has transpired and there is no recovery from the possession of the petitioner, rather from the house of one Balram Yadav, who has been granted bail by this Court vide order dated 20.9.2018 passed in Cr.Misc.No. 47730 of 2018 and petitioner is in custody for more than two months, having clean antecedent.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Maheshkhunt P.S.Case No. 50 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
