JUSTICE SUDHIR SINGH ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 341, 323, 325, 307/34 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons had assaulted Bidhu Bind and his wife with lathi and rod due to which both sustained injuries. The cause of assault is old dispute between them.

It has been submitted on behalf of the petitioner that he is in custody since 6.5.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. General and omnibus allegation has been made against the petitioner. No specific injury has been attributed against the petitioner. It is further submitted that petitioner may be released after completion of six months in custody, i.e., from 6.5.2016. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

No.29302 of 2016 (3) dt.01-09-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of six months in custody. i.e., from 6.5.2016 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Town) (Darigaon) P.S.
