Petitioners seek bail in a case registered under section 392 of the Indian Penal Code.

Rs 4, 10, 520/- was looted from a bank by four unknown persons. In course of investigation, some co- accused were arrested and they disclosed their involvement in the present case and also named the petitioners. Subsequently, Rs 15,000/- was recovered from the house of petitioner no.1 whereas Rs 14,000/- was recovered from the house of petitioner no.2 and police claimed that seized money was of looted property of the present case.

Submission on behalf of the petitioners is that the petitioners are in jail custody since 19.2.2016 but they have not been put on T.I. Parade as yet and so far as seized amount is concerned,

Patna High Court Cr.Misc. No.30765 of 2016 (3) dt.08-08-2016 there is no identification mark on the aforesaid seized money to show that seized cash was of looted property of the present case. No doubt, petitioners carry criminal antecedent but having more or less similar allegation co- accused Satrughan Singh has already been granted privilege of bail by this court. Accordingly, petitioners are directed to be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate X, Siwan in Bhagwanpur Hat P.S. Case no. 214/2015. shahid (Hemant Kumar Srivastava,J) U T
