====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 24-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Jhajha P.S.Case No. 16 of 2014 registered under Sections 147, 148,149, 341, 342, 323, 324, 326, 333, 307, 353, 395, 120(B) of the Indian Penal Code and 27 of Arms Act, pending in the Court of learned S.D.J.M., Jamui.
The accusation is of causing shot fire by the petitioner and others at the police personnel.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.12.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the witnesses alleged against the petitioner. Along with 20 persons this petitioner is also named in the FIR. There is no specific allegation against the petitioner. He has falsely been implicated in
Patna High Court Cr.Misc. No.35375 of 2016 (3) dt.24-10-2016 2/2 the present case. There is no other substantive evidence to suggest the implication of the petitioner in the present case. On behalf of the State, it has been submitted that the petitioner is named in the FIR. The police had gone to arrest the petitioner as there was non bailable warrant against him. The villagers including this petitioner attacked upon the police in protest to arrest of the petitioner. The pistol of the police was also snatched away by the accused persons. There are four other cases pending against the petitioner.
Considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner and same is rejected at this stage.
