JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-07-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.
Heard the learned counsel for the petitioner and Mrs. Anita Kumari Singh, the learned A.P.P. appearing for the State.
The petitioner apprehends his arrest in connection with Araria P.S. Case No. 1119 of 2019 for the offence punishable under Sections 363, 365, 366(A)/ 34 of the Indian Penal Code.
The allegation is regarding the petitioner having kidnapped the victim girl.
At this stage, the learned counsel for the petitioner
Patna High Court CR. MISC. No.16934 of 2020(2) dt.10-07-2020 2/2 has submitted that the petitioner has solemnized marriage with the victim girl, hence the present petition is being withdrawn with liberty to the petitioner to surrender before the learned court below and pray for regular bail and the learned court below be directed to consider the case of the petitioner sympathetically inasmuch as the petitioner has married the victim girl.
Accordingly, the present petition stands disposed of as withdrawn with liberty to the petitioner to surrender before the learned court below in connection with Araria P.S. Case No. 1119 of 2019, within a period of eight weeks from today, whereafter the learned court below shall consider the case of the petitioner for grant of regular bail in a sympathetic manner, however subject to verification of the fact as to whether the petitioner has solemnized marriage with the victim girl or not. The present petition stands disposed of as withdrawn with liberty to the petitioner to surrender before the learned court below and pray for regular bail.
