The petitioner seeks regular bail in connection with Forbesganj P.S. Case No. 818 of 2017 instituted for the offences under Section 30 of the Bihar Excise Prohibition Act, 2016. The allegation is regarding recovery of 20 litres of illicit liquor from the motorcycle being ridden by the petitioner. The learned counsel for the petitioner submits that he is not the owner of the motorcycle and in fact no recovery has been made from the conscious possession of the petitioner as well as he has been falsely implicated in the present case. It is further submitted that the petitioner has a clean antecedent and he is in custody since 27.10.2017.
Considering the nature of accusation, the period of
Patna High Court Cr.Misc. No.319 of 2018 (2) dt.19-01-2018 2/2 custody already undergone and the fact that the petitioner is having a clean antecedent, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Araria in connection with Forbesganj P.S. Case No. 818 of 2017.
