JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-02-2020 This application has been filed for cancellation of provisional bail granted to O.P.no.2 vide order dated 3.4.2014 by a Co-ordinate Bench of this Court in Cr. Misc. No.14306 of 2014 and later on the same has been confirmed vide order dated 22.4.2015 passed by the then Co-ordinate Bench of this Court on payment of Rs.7,500/- per month.

Grounds for cancellation of the bail are that no amount has been paid up till now and as such he has come for cancellation of bail due to violation of the condition of the bail. Learned counsel for the O.P.no.2, who has submitted that due to some difficulty he could not pay the amount but ready to pay the whole dues amount within a period of six

Patna High Court CR. MISC. No.33780 of 2019(5) dt.26-02-2020 2/2 months in two installments by the bank draft in favour of the petitioner and he will pay regularly the current amount to the O.P.no.2 in each month.

Considering the submissions as made above, I am not inclined to interfere with the order confirming the bail bond of the O.P.no.2, however, it is made clear that if there is failure in compliance of the condition, the bail bond of the O.P.no.2 shall be cancelled by the learned court below itself.
