JUSTICE ANIL KUMAR SINHA ORAL ORDER 06-12-2021 Heard Mr. Ranjeet Kumar Pandey, learned counsel for the petitioner, Mr. Gauri Shankar Gupta, learned Additional Public Prosecutor for the State along with Mr. Sanjay Kumar, learned counsel for the informant.

Petitioner seeks regular bail in connection with Siswan PS Case No. 179/2020 registered for the offence punishable under Sections 147, 341, 323, 302/120B of the IPC. The allegation against the petitioner, as per First Information Report, is that petitioner along with other accused persons caught hold the son of the informant and two accused persons, namely, Sonu Kumar Singh and Mithilesh Kumar Singh assaulted the son of the informant by means of dagger due to which, he died.

Learned counsel for the petitioner submits that both

No.29079 of 2021(2) dt.06-12-2021 2/3 the parties are co-villagers and petitioner, his three sons along with other family members have been implicated in this case due to previous enmity. He further submits that in the year 2018, petitioner had lodged an FIR against brother of the informant for causing damage of his motorcycle. Learned counsel next submits there is no allegation of assault upon the petitioner. On the other hand, learned counsel for the informant opposed the bail application and submits that the petitioner along with other family members caught hold of the son of the informant and two other accused persons assaulted him brutally by means of dagger due to which, he died.

Regard being had to the submissions made by the parties and taking into consideration the material on record and the fact that both the parties are co-villagers, there is previous enmity between them and specific allegation of assault upon the son of the informant is upon other two accused, namely, Sonu Kumar Singh and Mithilesh Kumar Singh and the petitioner is in custody since 14.08.2020 and charge-sheet has also been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, RAM PRAVESH SINGH be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount
