2. In the present case, the petitioners are apprehending their arrest in connection with Alinagar P.S. Case No. 51 of 2024, dated 18.05.2024, registered for the offences punishable under Sections 363 and 365 read with Section 34 of the Indian Penal Code.
3. As per prosecution case, petitioners kidnapped eighteen year old son of the informant.
4. Learned counsel for the petitioners submits that the petitioners are innocent and they have falsely been implicated in this case. The informant has woven a completely
Patna High Court CR. MISC. No.19280 of 2026(2) dt.06-04-2026 2/3 concocted story which is not believable. The missing boy was produced by the informant himself before the Police on 08.06.2024. Though the boy went missing on 17.05.2024, it is very much surprising that the said boy appeared for writing his examination on 22.05.2024. Learned counsel further submits that after investigation the Police exonerated the petitioners, finding the case untrue against the petitioners, but the learned Sub-Divisional Judicial Magistrate, Benipur, Darbhanga, differing from the final report, took cognizance against the petitioners. Learned counsel further submits that wife of petitioner no. 1 has filed a Complaint Case bearing C.R. No. 133 of 2024, in the Court of learned Additional Chief Judicial Magistrate, Benipur, Darbhanga, against the informant and his family members registered under Sections 341, 323, 379 and 504 of the Indian Penal Code. Learned counsel lastly submits that petitioners are having clean antecedent.
5. Learned APP opposes the submissions made on behalf of the petitioners.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the doubtful nature of allegation against the petitioners and

No.19280 of 2026(2) dt.06-04-2026 3/3 possibility of false accusation, let the petitioners, above-named, in the event of their arrest or surrender before the Court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipur, Darbhanga, in connection with Alinagar P.S. Case No. 51 of 2024, subject to the conditions as laid down under Section 482(2) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioners.
(ii) The petitioners will remain present on each and every date fixed by the Court below, if so required by the learned trial Court.
