JUSTICE SANJAY PRIYA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bajpatti P.S. Case No. 140 of 2018 instituted for the offence under Sections 341, 323, 307, 379/34 of the Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that there is case and counter case between the parties.

It is alleged that petitioner assaulted the informant with sharp weapon (sarauta) on head.

From the written report it appears that altercation took place for payment of money by the informant in betel shop. The injury report of the informant has been enclosed as Annexure-P2 which shows that he received two injuries on scalp which are only skin deep but Doctor has opined them to be dangerous to

Patna High Court Cr.Misc. No.55400 of 2018 (2) dt.20-09-2018 2/2 life. Counter case has also been filed by father of petitioner against the informant vide Bajpatti P.S. Case No. 147 of 2018. Petitioner is in custody since 7.6.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri at Sitamarhi, in connection with Bajpatti P.S. Case No. 140 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
