The petitioner apprehends his arrest in connection with Parihar P.S. Case No.10 of 2013 registered under Sections 341, 323, 353 and 504 of the Indian Penal Code.
The allegation against the petitioner is that on 17.01.2013, he went to the counter of computer at the office of Circle Officer, Parihar, with different type of applications for grant of certificates, and started abusing and locked the computer room. In the meantime, when the informant reached there, the petitioner started altercation with him.
Learned counsel appearing on behalf of the petitioner
Patna High Court Cr.Misc. No.39586 of 2014 (2) dt.09-04-2015 2/2 submits that except the offence under Section 353 of the Indian Penal Code, all the offences are bailable in nature. It is further submitted that, in fact, the petitioner is the Ex-Mukhia of the Gram Panchayat and had made complaint against the officials of the Circle Office at S.D.O., Sitamarhi, on 08.01.2013, due to that reason, the petitioner has falsely been implicated in this case. The petitioner has no criminal antecedent.
Having considered the facts and the circumstances of the case, let the petitioner, in the event of his arrest or surrender by him within four weeks, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Parihar P.S. Case No.10 of 2013, subject to the conditions laid down under Section 438(2) Cr.P.C.
