ANJANA MISHRA ORAL ORDER 28-07-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Laheriasarai P. S. Case No. 402 of 2015 registered for the offences punishable under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that there is dispute between the petitioner and his own uncle and on the basis of partition, the petitioner has been allotted 8 kathas of land out of old S.P. No. 4459 which was purchased by their ancestors.

It is further submitted by learned counsel for the petitioner that if at all the informant was aggrieved, he could have settled the matter by means of civil suit and therefore, the present

Patna High Court Cr.Misc. No.27677 of 2016 (2) dt.28-07-2016 2/2 case is wholly not maintainable.

Considering the nature of allegation against the petitioner that the informant is aggrieved and that also petitioner has got no criminal antecedent, let the petitioner, in the event of his arrest/surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned 2nd Additional Sessions Judge, Darbhanga in connection with Laheriasarai P.S. Case No. 402 of 2015 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
