The petitioner being the husband of the complainant is apprehending his arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 341, 379, 406, 120B of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture for nonfulfillment of the dowry demand. On the joint prayer of the parties the matter was referred to the Mediation Centre of Bihar State Legal Services Authority vide order dated 08.02.2016. The report of the Mediator dated 02.03.2016
Patna High Court Cr.Misc. No.34328 of 2015 (9) dt.31-03-2016 reflects that the issue has been resolved between the parties and both decided to part ways making payment of one time settlement amount of Rs. 3,85,000/-. The petitioner has filed Matrimonial Suit No. 205 of 2015 wherein the complainant will appear before the court concerned about the terms and condition between the parties for dissolution of dispute. It is submitted by the counsel for opposite party no. 2 that he received one time settlement amount of Rs. 3,85,000/-.
Considering the present stand of the parties, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Saran at Chapra in connection with Complaint Case No. 1657 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
