The petitioner seeks bail in Session Trial No. 5 of 2011 under Section 302/34 of the Indian Penal Code and under Section 27 of the Arms Act.

The prayer for bail of the petitioner was earlier rejected vide order dated 7.9.2015 with a direction to the learned trial court to conclude the trial within six months. It is submitted that the trial has not yet been concluded.

A report was called for and the learned 6th Additional Sessions Judge, Motihari has reported that the case is pending for evidence of the Doctor and the other witnesses have already been examined.

Considering the fact that the trial is at the fag end, I am

Patna High Court Cr.Misc. No.36154 of 2016 (3) dt.08-03-2017 2/2 not inclined to enlarge the petitioner on bail. The same is rejected. The trial court is directed to conclude the trial within three months from the date of receipt/production of a copy of this order.
