Earlier the petitioner was granted privilege of anticipatory bail, vide order dated 10.8.2017 passed in Cr. Misc. No.36517 of 2017 with direction that he will surrender within a period of four weeks, however the present application has been filed stating that he could not appear before the court below within the time due to lack of informant and now he is ready to appear, if one more chance is granted to him.

Heard learned A.P.P. also.

Having heard both sides and in view of the fact that he had been granted bail vide order dated 10.8.2017 passed in Cr. Misc. No.36517 of 2017 and now the petitioner has filed this application

Patna High Court Cr.Misc. No.59767 of 2017 (2) dt.13-12-2017 2/2 for modification of order dated 10.8.2017 passed in Cr. Misc. No.36517 of 2017 after about four months and that clearly shows how much respect he has for the direction of the Court. In such view of the matter, I am not inclined to interfere with the order passed by this Court, however, the petitioner shall appear within a period of four weeks from the date of order and pray for regular bail, which will be considered by the learned court below and also the fact that he had been earlier granted privilege of anticipatory bail by this Court and shall dispose of the application of the petitioner.

With the aforesaid observation, this application is disposed of.
