JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Maner P.S. Case No. 191 of 2018 for the offence registered under Section 414 of the Indian Penal Code.
Learned counsel for the petitioner submits that unfortunately petitioner has been made accused for theft of his own motorcycle, which is subject matter of the instant case. The said motorcycle was gifted by in-laws and while coming to purchase medicines in connection with treatment of his pregnant wife petitioner was apprehended and has been made accused in the instant case. He referred to the affidavit to submits that the deponent of this case is sister-in-law of the petitioner. The motorcycle was in fact purchased in the name of the deponent of this case.
