22.07.2020 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Kawakole P.S. Case No. 197 of 2019 dated 11.07.2019 Instituted for the offences under Sections 341, 323, 307, 354(A), 504 and 34 of the Indian Penal Code.

It has been alleged in the First Information Report that the petitioner assaulted the informant by means of an iron rod. The other

persons are also alleged to have assaulted the members of the prosecution party.

Learned counsel for the petitioner has submitted that even though the occurrence had taken place on 09.07.2019 but the F.I.R. was lodged on 11.07.2019. The parties are stated to be agnates and the occurrence took place with respect to the performing of Puja. The informant and her husband have reportedly received simple injuries. Regard being had to the nature of accusation against the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of this order on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Nawada in connection with Kawakole P.S. Case No. 197 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. .
