JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Supaul P.S. Case No.372/2018 for the offence registered under Sections 366A/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He submits that from the statement of the victim recorded under 164 Cr.P.C. it is evident that the petitioner has joined wedlock with the victim she was not willing to return back to parent house. She wanted to stay with the petitioner at her in law's house.
Considering the totality of the facts and circumstances of the case, let the petitioner named above is directed to be released on furnishing bail bond of Rs. 10,000/- (Rupees ten
Patna High Court Cr.Misc. No.54433 of 2018 (2) dt.20-09-2018 2/2 thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Supaul P.S. Case No.372/2018.
