The petitioner apprehends his arrest in a case registered for the offence under Sections 376, 420, 354(D) of the Indian Penal Code.

As per the prosecution case, on the false promise of marriage, petitioner is alleged to have established physical relation with the informant.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case by the informant only with a view to blackmail the petitioner. It is further submitted that informant is already married with one Sujit Kumar and presently residing with him at New Colony, Kalibari, Railway

Patna High Court CR. MISC. No.20414 of 2020(9) dt.16-11-2022 2/2 Quarter No. 436 (E) under P.O. & P.S. and District Bongaigaon, Assam.

However, learned A.P.P. for the State opposed the bail petition and submitted that there is specific allegation against this petitioner of establishing physical relation with informant on the pretext of marriage. The informant, in her statement recorded under Section 164 Cr.P.C., has supported the prosecution case.

Considering the nature of accusation and statement of the informant recorded under Section 164 Cr.P.C., the prayer for anticipatory bail of petitioner is rejected.
