ANJANA MISHRA ORAL ORDER 17-08-2015 Learned counsel for the petitioners is permitted to make necessary correction in paragraph No. 1 of the present application. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend his arrest in connection with a case registered for the offences punishable under Sections 147, 148, 149, 326, 341, 360, 379, 380, 307, 504 and 506 of the Indian Penal Code.
Learned counsel for the petitioners submits that the entire case against these petitioners are false and mischievous and have
Patna High Court Cr.Misc. No.32923 of 2015 (2) dt.17-08-2015 P2/2 been engineered on account of the fact that the informant's husband is the cousin of these petitioners and they have been engaged in a proceeding under Section 144 and there is also history of land dispute between the parties. Allegations as made out under Section 379 are also ornamental and none of the petitioners have taken any amount from the house of the informant.
Considering the aforementioned fact and also the fact that these petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 430 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
