The petitioner apprehends his arrest in Barhara P.S. Case No. 142 of 2013 registered under section 302 and other allied sections of the Indian Penal Code.

The informant named two persons namely Bipin @ Pipin Mahto and Vijay @ Vijay Mandal . It is submitted that petitioner is not named in the first information report. Name of the petitioner figured in the case in the confessional statement of co-accused who is named in the first information report. Considering the facts and the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly the same is

Patna High Court Cr.Misc. No.40981 of 2014 (3) dt.01-04-2015 2/2 rejected. The petitioner, if so advised, may surrender and seek regular bail. The court below shall consider the regular bail of the petitioner taking into consideration that similarly situated coaccused has already been granted regular bail.
