The petitioner is apprehending arrest in a case registered under section 7 of the E.C. Act and 34 of the Indian Penal Code.

According to the first information report lodged by the Circle Office, the SHO of Salkhua P.S. who seized 32 quintal of rice being carried on the tractor-trailer and it was suspected that it was Government rice being transported for selling in the black marketing.

It is submitted by the learned counsel for the petitioner that petitioner is owner of the tractor in question which was being used as a public carrier. It is further submitted that the

Patna High Court Cr.Misc. No.32863 of 2015 (2) dt.11-08-2015 2/2 petitioner has no criminal antecedent.

Considering the aforesaid facts, the above named petitioner in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in Salkhua P.S. Case No. 69 of 2015 , subject to the conditions as laid down under section 438(2) Cr.P.C.
