2. The petitioner apprehends his arrest in a case registered for offence under Sections 30(a), 32(i)(ii), 36, 41(1) of the Bihar Prohibition and Excise Act.
3. On the alleged date and time of occurrence, the police intercepted a truck, bearing registration no. HR38X-7707 with driver and co-driver and recovered about 2323.36 liters of illicit liquor and on query, they disclosed the name of petitioner, who stated them for carrying liquor from Sonipat (Haryana) to Bihar.
4. It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the alleged truck and has got no concern with the alleged recovery of illicit liquor. No incriminating article has been recovered from his possession and he has been made accused only on confession of apprehended
Patna High Court CR. MISC. No.22086 of 2024(2) dt.20-03-2024 2/2 accused persons. Petitioner has got no criminal antecedent of similar nature.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-I cum A.D.J. IV, Kaimur at Bhabua in connection with Mohania P.S. Case No. 283 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
