JUSTICE MADHURESH PRASAD ORAL ORDER 21-02-2018 Heard counsel for the petitioner and the State. Petitioner, who is husband of the deceased, is an accused in a case registered for offence under sections 302, 328, 201/34 of the IPC.

It is alleged that the petitioner killed his wife by administering her poison.

Counsel for the petitioner, by referring to paragraphs 2, 3, 12 and 23 of the case diary, submits that the informant and his family members had due information regarding illness of the deceased and they were present during her treatment. He submits that the petitioner has falsely been implicated in this case due to suspicion. Petitioner is in custody since 12.10.2017. Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rohtas at Sasaram in PS.Case No. -257 Year- 2017 Thana -NOKHA DistrictSASARAM (ROHTAS) on the following conditions:- (a) One of the bailors will be a close relative of the
