JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and State. The petitioner is custody in connection with Magadh University P.S. case no. 58 of 2010 for the offence under Sections 452, 449, 342, 307, 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He submits that the petitioner was engaged in prosecution of his B.Ed. course and as such earlier he has not surrendered in the instant case. He further submits that there is no specific overt act causing injury to the informant side. Learned counsel submits that the similarly circumstanced other co-accused Shiv Nath Yadav, against whom identical allegation was leveled in the case, has been granted bail vide order dated 04.01.2012 in Cr. Misc. No. 36431 of 2011.

No.54245 of 2018 (2) dt.20-09-2018 2/2 Considering the totality of the facts situation, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Magadh University P.S. case no. 58 of 2010.
