JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-06-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sessions Trial No. 428/2019 arising out of Akbarpur P.S. Case No.234 of 2013 registered for the offenses under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioner would submit that allegation against the petitioner is that he was one of the members of the unlawful assembly which caused murder of the brother-in-law the informant. The allegation of assault is against co-accused Ramotar Pandit. Similarly circumstanced co-accused Kuldeep Pandit has been granted bail by a coordinate Bench of this Court.

Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Twenty five Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Nawada in connection with Sessions Trial No. 428 of 2019 arising out of Akbarpur P.S. Case No. 234 of 2013. On release the petitioner shall render his services as volunteer to combat the pandemic of Covid-19 for a period of one month. He is required to report to the Civil Surgeon/ Nodal Officer, Covid-19, Nawada, who shall utilize his services appropriately.
