1. Heard learned counsel for the petitioner as well as learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 34 of the IPC.

3. The learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the informant.

4. It is next submitted that from perusal of the FIR, it would manifest that the date of occurrence is 23.08.2023 and FIR came to be instituted on 27.08.2023 and thereafter the same was seen by the learned ACJM on 04.09.2023, as such there was delay in instituting the FIR and the fact that it reached the learned Trial court after a delay of nearly more than six days

Patna High Court CR. MISC. No.26385 of 2024(2) dt.20-04-2024 2/2 that also casts an aspersion on the case of the prosecution. It is next submitted that even allegation of assault is not specific.

5. The learned APP opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., V, Ara, Bhojpur in connection with Agiaon Bazar P.S. Case No.177 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
